Steve BoltsSAN LUIS OBISPO – A San Luis Obispo County Court judge has granted a request to have Undersheriff Steve Bolts' blood alcohol retested.
His defense attorney made the request in court Wednesday morning during an arraignment hearing.
Police in Atascadero arrested him for drunk driving last month.
The original blood test showed his blood alcohol level was .09%.
Bolts was not present in court, however his defense attorney entered a not guilty plea on his behalf.
State law allows an attorney to appear on behalf of a client charged with a misdemeanor.
Bolts' attorney is hoping to settle the case without going to trial.
"It's a terribly difficult situation whenever someone who is a public figure, whether it's a police officer. A defense attorney, a DA, a judge or whoever it might be finds themselves embroiled in this type of system, but you know, I believe that we'll be able to resolve the matter," said Bolts defense attorney Chris Casciola.
The case is set for a pre-trial hearing on August 23rd.
