MONTEREY, Calif.- New information about the controversy in the Monterey County Sheriff's Office.
Tuesday, one of Scott Miller's sergeants was back in court asking for an injunction against him.
It's the same sergeant who arrested Miller's son on drug charges.
Both sides were back in court to argue this case before a judge who now has to decide whether an injunction is necessary.
Warren's side said it is because of a series of actions by Sheriff Miller and Undersheriff Max Houser showing they're retaliating against Warren for arresting Miller's son.
Those actions include: unusual interrogation by Houser of Warren, breaking into Warren's office safe, transferring Warren out of narcotics and into the coroner's office, and opening a personnel investigation about whether warren compromised a marijuana bust by telling the media.
Miller's side called all of this pure speculation and Warren doesn't have any facts to back up his claims.
In fact, Miller thinks his request to have the Department of Justice do its own investigation proves that.
"Since Mr. Warren is claiming this is retaliation. It's better to have an outside independent person with no dog in the fight, take a look at it," said Martin Mayer, Miller's attorney.
"You say it's going to be DOJ, you say it's outside people, but you're still trying to do a parallel investigation and that needs to stop," said Jeff Edwards, representation for Archie Warren.
The judge can take as long as he wants to decide to grant or deny that injunction to prevent Miller or his department from any other retaliatory action going forward. A judge denied a temporary restraining order last month.
In addition, Tuesday Monterey County Supervisors approved a $20,000 contract for an outside consulting firm to look into the investigation Miller opened against Sgt Warren.
Miller wouldn't tell me if the personnel matter in this contract was Warren but the contract describes his situation, "Insubordination for not complying with a lieutenant in charge of a regional narcotics team and provided confidential info to a news reporter that resulted in abortion of a major narc operation."
Miller did say this is separate from the DOJ investigation and he hopes to hear from them soon.
