San Luis Obispo - The recent plastic bag-ban in San Luis Obispo County is already up against a lawsuit.
But a group called Save The Plastic Bag dropped San Luis Obispo County and cities from the law suit... and is now only suing the Integrated Waste Management Authority.
Save The Plastic Bag claims Waste Management violated the California Environmental Quality Act because it did not do an environmental impact report before passing the ban.
Bags are banned in 39 California cities and counties.
Bill Worrell of Integrated Waste Management says, "We basically adopted the same ordinance as Marin County adopted. Save The Plastic Bag litigated against them and in September the Superior Court in Marin County ruled in favor of the county up there so we are very confident we will have the same ruling down here."
Californians use an estimated 19-billion plastic bags a year, we use about 130-million a year in San Luis Obispo County.
Waste Management says only about 3-percent of those bags are recycled statewide.
