SAN LUIS OBISPO, Calif-You may know Dr. Will Powers for protesting the gas at costco. He's out there up to 5 times a week and is used to being verbally harassed but about a month ago he says he was assaulted by a city fire department employee.
"I heard him say get out of the way, I've heard that before so I kept talking so he reached out and he grabbed my bullhorn and shoved it toward me," says Powers.
Powers then noticed the man who allegedly shoved him was driving a truck with a San Luis Obispo City Fire Department logo on it. He filed a claim for 5 million dollars against the city.
"The city's investigation concluded the city employee, while at costco in the regular conduct of his job duties, was concerned for Mr. powers' safety and suggested Mr. powers move back to an area out of the path of oncoming traffic," says Monica Irons, San Luis Obispo's Human Resources Director.
The city has filed a claim with their insurance company. If the claim is rejected, Powers will be notified and he says he will file a lawsuit.
