Trial Set for CHP Officer Accused of DUI

SAN LUIS OBISPO, Calif. - The California Highway Patrol Officer accused of driving under the influence in Arroyo Grande has a trial date for January 28, 2013.

Michael Mallory is accused of crashing into two parked cars while off-duty in August 2012.

Officers say Mallory showed signs of impairment at the scene and blood tests came back positive for the sleeping sedative Ambien.

Mallory and his attorney tried to reach a deal with the San Luis Obispo County District Attorney's office but declined all offers.

Mallory will be back in court January 22, 2013 to determine whether this trial date stands or needs to be changed.
