Tibor Karsai Could Be Released into Santa Barbara County

SANTA BARBARA, Calif. - The Sacramento Court of Appeals has denied the Santa Barbara County District Attorney's Petition to prevent the release of Tibor Karsai into Santa Barbara County according to District Attorney Joyce Dudley.

The Court of Appeal for the Third District denied Dudley's Writ of Mandate to stop Karsai, who has been deemed a "sexually violent predator (SVP)," from being released in Santa Barbara County.

The Court of Appeal says that now Karsai can be released as a transient.

According to the District Attorney Joyce Dudley, "In their 21-page opinion the Court of Appeal ruled, 'there is nothing in SVPA that precludes a court from ordering the conditional release of a person committed as an SVP even though no fixed residence has been located for the person before his release.'"

A second  petition will now be filed by the Santa Barbara COunty District Attorney's Office to the California Supreme Court.

That will be a final attempt to prevent Karsai from being released into Santa Barbara County as a transient.

The District Attorney's Office will also file a stay to stop Karsai from being released while the case is still in the hands of the Supreme Court.
