SAN LUIS OBISPO COUNTY, Calif- Two suspects accused of killing 15-year-old Dystiny Myers were in court Monday for a motion hearing. The district attorneys office dismissed charges against both Rhonda Wisto and her son Frank York for attempted pre-meditated murder of Cody Miller. Miller has already pleaded guilty to pre-meditated first degree murder and conspiracy to commit murder.
The DA also submitted letters to the judge and defense, written by York. The DA said in court the letters show existence of conspiracy to commit murder. Potential jury members will be brought in Wednesday for hardships, to decide whether or not they will serve. Both York and Wisto have waived their presence at the hardships.
Depending on how long it takes to put a jury together, opening statements could possibly be heard on March 11th.
