SAN LUIS OBISPO, Calif. - There are new developments in the Dystiny Myers murder trial.
Central Coast News has learned that one of the defendants -- Cody Miller -- has withdrawn his plea and has now pleaded not guilty to all charges. Miller has also decided not to testify against the other suspects.
All five defendants -- Rhonda Wisto, Frank York, Ty Hill, Jason Greenwell and Cody Miller -- originally pleaded not guilty to first degree murder charges.
Greenwell has agreed to take a plea deal in exchange for his court testimony.
Hill pleaded guilty to first degree murder with four enhancements and was sentenced to life without parole.
Miller had pleaded guilty to pre-meditated first degree murder and conspiracy to commit murder. He had also agreed to testify against the other suspects in this case. But, Miller has now pleaded not guilty to all charges and will not testify.
If convicted, Miller faces life in prison without parole.
Myers' body was found in a shallow grave east of Highway 58 in Santa Margarita on Sept. 26, 2010.
Cal Fire was called to the area for a brush fire and found the 15-year-old girl's body. The body was badly burned.
The trial setting is scheduled for 9 a.m. Tuesday.
