SAN LUIS OBISPO, Calif- A defendant in the Dystiny Myers murder case has been sentenced to life without parole. Miller withdrew his guilty plea for another guilty plea of first degree premeditated murder and conspiracy, but not he will serve longer prison sentence. His attorney, Gael Mueller, said Miller had been thinking about this since he entered his plea deal of 39 years to life in prison with the DA in January, and said he didn't deserve a break or forgiveness.
After his sentencing the family stood up and spoke. "I hate that when I want to go lay next to her I have to go lay on the ground, by the cemetery plot, that's the only way I can lay with my daughter, and I want to hold her, just close my eyes and pretend she's next to me," said Aileen Myers, Dystiny's mother.
Aileen stood up after Millers sentencing to say her final words to the man who admitted to killing her 15-year-old daughter. She told him with tears in her eyes he is not forgiven, but Dystiny's grandmother said she has found peace. "I would like Mr. Miller to know that I do forgive him, because I believe that is something I personally have to do in my heart," said Dystiny's grandmother, Kathleen Clark. Although she made it clear to Miller what he stole from their family.
"We'll never get to see Dystiny graduate from high school, go to a prom, get married, have children, she was the most precious thing in our life," said Clark. With the families permission, Miller had a few words to say as well. "I really am sorry, I understand I have done terribly wrong to you guys and Dystiny, nothing I can ever do will ever bring her back if I could I would change everything and I can't," said Cody Miller, a defendant in the murder case.
Millers attorney said it is highly unusual for a client to change their plea and receive a harsher sentence. She also said miller was very religious and he wouldn't have done something like this if it weren't for being on drugs.
