SANTA MARIA - Jurors in the murder trial of Lompoc Federal Prison guard Timothy McNally watched the videotaped police interview of McNally at police headquarters after he was arrested for shooting and killing Victorville Federal Prison guard Gary Bent in a room at the Embassy Suites in Lompoc on March 8, 2012.
McNally told detectives he was really "f---ed up" and acting "stupid" waving and pointing a loaded handgun at Bent as Bent was preparing to vomit in his hotel room bathroom.
McNally said he was taunting and teasing Bent with the gun, calling him "pussy" when he pulled the trigger firing a single round at Bent's neck that killed almost instantly.
McNally said he became "freaked out" by the shooting and "didn't believe it was real" and that he never intended to shoot or harm Bent saying the two were having a good time partying together that night.
McNally said he sat in the hotel room for about 15 to 20 minutes before driving to his father's house in Lompoc without calling 911 to report the accidental shooting and bring medical attention for Bent.
Detectives questioned McNally about text messages he sent to a friend right after the shooting saying he had just shot Bent.
McNally told detectives he couldn't understand how he could pull the trigger on the gun saying he had 13 years of firearms safety training in the Army and as a law enforcement officer in the federal prison system.
A detective told McNally he should have "known better" than to point a loaded gun at Bent.
The prosecution has also called witnesses to testify that McNally and Bent had been consuming alcohol and a synthetic drug known as "bath salts" prior to the shooting.
The prosecution says McNally is guilty of second degree murder for his reckless use of a loaded gun while under the influence of drugs and alcohol.
The defense says McNally and Bent were friends, were having a good time partying together and that the shooting was a complete accident and therefore manslaughter not murder.
The judge is not allowing news cameras in Santa Maria Court for the trial which continues next week.
