SACRAMENTO, Calif- A bill being considered by state lawmakers would allow sperm donors to argue for parental rights in court.
Sperm donors are not currently considered natural fathers unless he and the child's mother have signed documents prior to conception.
Hollywood actor Jason Patric is helping push the bill. He lost a custody battle after donating sperm for his girlfriend, who conceived their now 3-year-old son, leaving Patric without parental rights.
"You would have to prove that you have brought that child into your home, that you have established a parental relationships, that you provided for the child and that would be up to a judge to decide if it's in the best interest of the child," said Senator Jerry Hill.
The bill is opposed by Assemblymember Tom Ammiano, a leading voice in the legislature for gay rights. He says it's inappropriate for lawmaker to get involved in family custody cases.
